1. Agreement to Terms

By accessing or using the Rose Rock Monument website at https://rose-rock.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, please do not use our website or services.

2. Services Offered

Rose Rock Monument provides the following memorial services:

• Custom monument design and fabrication
• Monument and headstone installation
• Monument restoration and repair
• Design consultation and memorial planning

All services are subject to availability. Information on our website is provided for general informational purposes and does not constitute a binding offer.

3. Order Process & Deposits

All monument orders require a written order form signed by the customer. The following payment terms apply:

• A 50% deposit is required to begin work on any order
• Final payment is due upon completion, before installation
• Accepted payment methods: cash, check, credit card, and debit card

Final pricing will be confirmed in writing before any work begins. Prices are subject to change without notice for new orders.

4. Design Approval

Before fabrication begins, the customer must approve a design proof in writing. This approval confirms the layout, text, artwork, and granite selection. Please review your proof carefully:

• Changes requested after written approval may incur additional fees
• Natural granite color and texture may vary slightly from samples, as each stone is unique
• Rose Rock Monument is not responsible for errors in customer-approved proofs

5. Fabrication Timeline

Typical fabrication time is 8–14 weeks from the date of design approval. Timelines may vary depending on complexity, material availability, and seasonal demand. We will communicate any significant delays promptly.

6. Cancellation & Changes

• Before fabrication begins: Your deposit will be refunded minus any design and administrative fees incurred.
• After fabrication begins: The deposit is non-refundable, as materials have been purchased and work has commenced.
• Changes after approval: Design changes after fabrication has begun may delay the timeline and incur additional costs.

7. Installation

Monument installation is performed by our team. Please note:

• The customer is responsible for obtaining any required cemetery permits and ensuring the foundation is prepared, unless otherwise agreed in writing
• Rose Rock Monument is not responsible for delays caused by cemetery scheduling, weather, or other factors beyond our control
• Installation scheduling is subject to cemetery rules and availability

8. Warranty

Rose Rock Monument provides a one-year warranty on craftsmanship from the date of installation. This warranty covers defects in engraving, lettering, and structural integrity of our work.

The following are not covered by our warranty:

• Natural granite color variation and mineral characteristics
• Normal weathering and aging of stone
• Damage caused by the cemetery, third parties, or vandalism
• Acts of nature or environmental damage

Warranty claims must be submitted in writing within the warranty period.

9. Limitation of Liability

The total liability of Rose Rock Monument for any claim arising from our services shall not exceed the total amount paid by the customer for the specific order in question.Rose Rock Monument shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New Mexico. Any disputes arising from these terms or our services shall be resolved in the courts of Otero County, New Mexico.

11. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Any changes will be posted on this page with an updated “Last updated” date. Your continued use of our website after changes are posted constitutes your acceptance of the revised terms.
